Terms of Service

1. Acceptance of Terms

By accessing or using O365Validator ("Service"), operated by Trifident LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You represent that you have the authority to bind your organization to these Terms if you are using the Service on behalf of an organization.

2. Description of Service

O365Validator is a security assessment tool that analyzes Microsoft 365 tenant configurations against security best practices. The Service:

  • Connects to your Microsoft 365 tenant via OAuth with read-only permissions
  • Analyzes security configurations against industry frameworks
  • Provides reports with findings and remediation recommendations
  • Does NOT modify any settings in your Microsoft 365 tenant

3. Account Registration

To use the Service, you must authenticate using your Microsoft 365 credentials and grant the required read-only permissions. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other users' data
  • Interfere with or disrupt the Service infrastructure
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems to scrape or collect data from the Service
  • Resell or redistribute the Service without authorization
  • Use the Service to assess tenants without proper authorization

5. Intellectual Property

The Service, including all content, features, and functionality, is owned by Trifident LLC and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

You retain ownership of your data. By using the Service, you grant us a limited license to access your Microsoft 365 configuration data solely for the purpose of providing security assessments.

6. Fees and Payment

Some features of the Service may require payment. If you subscribe to a paid plan:

  • You agree to pay all applicable fees
  • Fees are non-refundable except as required by law
  • We may change fees with 30 days' notice
  • You may cancel at any time; access continues until period end

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unscheduled maintenance or emergency repairs
  • Issues with third-party services (including Microsoft)
  • Circumstances beyond our reasonable control

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of assessment results
  • Uninterrupted or error-free operation
  • Security of your data beyond our stated practices

Assessment results are recommendations based on known best practices. They do not constitute professional security advice, and you are responsible for decisions made based on these results.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIFIDENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities
  • Security breaches resulting from unaddressed findings
  • Decisions made based on assessment recommendations
  • Service interruptions or data loss

Our total liability for any claims shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Trifident LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Assessments of tenants without proper authorization

11. Termination

We may suspend or terminate your access to the Service at any time for:

  • Violation of these Terms
  • Non-payment of fees
  • Suspicious or fraudulent activity
  • Any reason with reasonable notice

You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Kansas City, Missouri.
